Potter Worx Ltd – Terms and Conditions

These Terms and Conditions ("Terms") govern bookings, purchases and participation in experiences provided by Potter Worx Ltd.

By making a booking or purchasing a ticket from Potter Worx Ltd, you agree to these Terms and any additional terms specifically provided for the event or service you have booked.

 

Nothing in these Terms affects your statutory rights.

Potter Worx provides mobile pottery painting experiences at customer, partner and third-party venues, as well as public and collaborative pop-up events.

 

2. Our Experiences

Potter Worx offers different pottery painting experiences. The materials, finishing process and collection arrangements applicable to your booking will be identified as part of the event or service description.

2.1 Glazed & Kiln-Fired Experiences

For experiences using ceramic underglaze paints, Potter Worx provides the pottery, paints, brushes and relevant creative materials.

Following the event, completed pottery is taken into the care of Potter Worx for professional glazing and kiln firing.

Finished pottery will then be returned or made available for collection in accordance with the arrangements specified for the relevant booking.

Once professionally fired, ceramic pieces are generally suitable for their intended ceramic use. Any specific care instructions provided by Potter Worx should be followed.

2.2 Acrylic & Ornamental Experiences

For experiences using acrylic paints or acrylic paint pens, completed items are normally available to take home on the day and do not undergo glazing or kiln firing.

These pieces are intended for ornamental and decorative use only.

Unless expressly stated otherwise, acrylic-finished pottery is not food-safe, dishwasher-safe or waterproof and should not be used to hold food or liquids or be exposed to high temperatures.

 

3. Bookings & Payment

3.1 Public Events & Individual Tickets

Public events and individual ticketed experiences must normally be paid for in full at the time of booking.

A booking is confirmed once payment has been successfully received and Potter Worx or its authorised ticketing platform has issued confirmation.

Ticket prices, inclusions and any event-specific conditions will be displayed before purchase.

 

3.2 Private & Bespoke Events

Private, corporate, celebration, Tipsy Potter and other bespoke group experiences may require a deposit to secure the requested date.

Unless otherwise stated in your quotation or booking confirmation:

  • A 50% deposit is payable to secure the booking.

  • The remaining balance is due no later than 24 hours before the scheduled event.

  • Final participant numbers must be confirmed no later than 7 days before the event.

A requested date is not secured until the required deposit has been received and Potter Worx has confirmed the booking.

 

3.3 Booking Information

Customers are responsible for providing accurate booking, venue, contact and participant information.

Please notify Potter Worx as soon as reasonably possible if any booking information changes.

 

4. Private Event Cancellations, Deposits & Rescheduling

 

4.1 Customer Cancellation

Private and bespoke events require Potter Worx to reserve time, plan resources and, in many cases, purchase or allocate pottery and materials specifically for the booking.

 

If you cancel a private or bespoke event, Potter Worx may retain from payments already made an amount reasonably required to cover losses directly resulting from the cancellation.

 

These may include:

  • Pottery or materials specifically purchased or allocated to your booking that cannot reasonably be reused or resold;

  • Reasonable administrative costs already incurred;

  • Non-recoverable third-party costs incurred specifically for your event; and

  • Other direct losses reasonably resulting from the cancellation, taking account of costs saved and our ability to mitigate or recover those losses.

 

Potter Worx will not seek to recover the same loss twice.

 

Where payments received exceed Potter Worx's reasonable cancellation losses, the remaining balance will be refunded.

This does not affect your statutory rights.

4.2 Cancellation Within 72 Hours

Where a private event is cancelled within 72 hours of its scheduled start time, Potter Worx may have incurred substantial costs and may have limited opportunity to accept another booking for the reserved date.

Any amount retained will nevertheless be limited to Potter Worx's reasonable losses resulting from the cancellation and will take account of costs saved or reasonably recoverable.

 

4.3 Rescheduling

Private-event customers may request to reschedule their booking once, provided at least 72 hours' written notice is given.

Rescheduling is subject to Potter Worx availability and must be confirmed in writing.

Where Potter Worx has already incurred event-specific costs that cannot reasonably be transferred to the new date, those costs may remain payable.

4.4 Final Participant Numbers

Final participant numbers must normally be confirmed at least 7 days before the event.

Pottery and materials may then be purchased or allocated according to the confirmed number.

Where participant numbers subsequently decrease, any refund or price adjustment will take account of costs Potter Worx has already reasonably incurred and whether allocated stock can reasonably be reused or resold.

Where participant numbers increase, additional participants are subject to availability and any applicable additional charges.

5. Public Event Tickets & Dated Leisure Activities

Individual tickets purchased for Potter Worx public events and pop-up experiences are normally for a leisure activity taking place on a specified date or during a specified period.

 

Where Regulation 28(1)(h) of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 applies, the statutory 14-day cancellation right applicable to many distance contracts does not apply.

 

Accordingly, unless the particular event terms state otherwise, tickets for dated Potter Worx leisure events are non-refundable if you change your mind or are unable to attend, subject always to your statutory rights.

 

Tickets are non-transferable unless Potter Worx agrees otherwise in writing or the event-specific terms permit transfer.

If you cannot attend, please contact Potter Worx as soon as possible. Potter Worx may, at its discretion, offer an alternative arrangement or goodwill solution, but is not obliged to do so where no statutory right to cancellation exists.

 

6. Cancellation or Material Changes by Potter Worx

Occasionally Potter Worx may need to cancel, postpone or materially change an event because of circumstances such as illness, venue unavailability, equipment failure, safety concerns or circumstances outside our reasonable control.

If Potter Worx cancels an event or service and cannot provide an appropriate alternative, customers will be offered a refund of amounts paid to Potter Worx for the affected service.

 

Where an event is postponed or materially changed, customers will be informed as soon as reasonably practicable and provided with appropriate options according to the circumstances and their statutory rights.

Nothing in this section limits any statutory remedy to which a customer may be entitled.

 

7. Customer & Venue Responsibilities

7.1 Venue Requirements

Where the customer provides or nominates the venue, the customer is responsible for ensuring that the venue is suitable for the booked experience and provides any facilities agreed during booking.

These may include:

  • Appropriate tables and seating;

  • Reasonable lighting;

  • Safe access for setup and removal;

  • Access to running water where required; and

  • Adequate space for participants and Potter Worx equipment.

Any specific venue requirements will be communicated before the event.

 

7.2 Children & Supervision

Children participating in Potter Worx activities must remain appropriately supervised by their parent, carer or responsible adult unless an alternative supervision arrangement has been expressly agreed in writing.

Potter Worx facilitators provide creative instruction and activity guidance but do not provide childcare unless expressly contracted to do so.

7.3 Safety

Participants must follow reasonable safety and handling instructions given by Potter Worx facilitators and the venue.

Parents and carers are responsible for ensuring children in their care follow those instructions.

 

8. Pottery, Equipment & Breakages During Events

Unfired ceramic bisque is inherently fragile and must be handled carefully.

 

Where a participant or accompanying guest breaks or materially damages a pottery piece through dropping, inappropriate handling or misuse during an event, and a replacement item is requested, Potter Worx may charge for the replacement pottery.

 

Any replacement charge will be communicated before the replacement is provided.

 

Customers and guests must also take reasonable care of Potter Worx equipment and materials.

 

Where Potter Worx equipment is deliberately damaged or materially damaged through misuse or negligence, Potter Worx may seek the reasonable cost of repair or replacement from the person responsible or, where appropriate, the booking customer.

 

This provision does not apply to ordinary wear and tear, accidental damage that is not attributable to misuse or negligence, or damage for which Potter Worx is responsible.

 

9. Glazing, Kiln Firing & Handmade Variations

 

9.1 The Ceramic Process

For glazed and kiln-fired experiences, Potter Worx will transport completed pottery for professional glazing and kiln firing.

The ceramic process involves interactions between bisque, underglaze, clear glaze and kiln heat.

 

As a result, finished pieces may display natural variations in:

  • Colour;

  • Glaze finish;

  • Texture;

  • Brush marks;

  • Surface appearance; and

  • Other characteristics inherent in handmade ceramics.

 

Minor variations and characteristics that naturally result from the creative and firing process are not considered defects.

 

9.2 Customer Artwork

Potter Worx cannot guarantee that colours will appear exactly as they did before firing or that a customer's finished design will precisely match an example, photograph or expected result.

Individuality and variation are inherent parts of hand-painted pottery.

This does not affect your rights where an item or service does not meet the standards required by law.

 

10. Damage, Loss & Technical Kiln Failures

Potter Worx will take reasonable care of pottery while it is in our possession.

In the unlikely event that a ceramic piece is lost or materially damaged as a direct result of an operational handling error or technical failure while in the care of Potter Worx, we will provide an appropriate remedy.

 

Depending on the circumstances, this may include:

  1. A replacement pottery piece together with a complimentary opportunity to recreate the item; or

  2. A refund of the amount paid for the affected pottery item or individual experience.

 

Because hand-painted pottery may be unique or sentimental, Potter Worx recognises that a replacement cannot recreate the original artwork. However, Potter Worx is not responsible for losses that are purely sentimental or subjective where such liability can lawfully be excluded.

 

Nothing in this section limits any statutory rights or remedies available to the customer.

11. Finished Pottery, Return & Collection

11.1 Standard Processing Time

Finished kiln-fired pottery will normally be ready for return or collection within 10 working days of the event unless a different timeframe is stated for the particular experience.

 

This is an estimated processing period rather than a guaranteed delivery date unless expressly agreed otherwise.

If an unexpected kiln, utility, supplier or logistics issue causes a material delay, Potter Worx will endeavour to inform affected customers and complete the order as soon as reasonably practicable.

 

11.2 Direct Customer Collection or Delivery

Where pottery is collected directly from Potter Worx, responsibility for its safekeeping passes to the customer once it has been handed over.

 

Where Potter Worx delivers pottery directly to the customer, responsibility for its safekeeping passes once the pottery has been safely delivered and accepted.

11.3 Return to a Partner Venue

Where the agreed arrangement is for Potter Worx to return completed pottery to a nursery, school, business, event venue or other collection point, Potter Worx's responsibility for storage and safekeeping ends once the pottery has been safely delivered to and accepted by the agreed venue or authorised representative.

Potter Worx cannot accept responsibility for pottery subsequently lost, misplaced, dropped, broken or otherwise damaged after safe handover, except where Potter Worx is legally responsible.

11.4 Uncollected Pottery

Where pottery is being held directly by Potter Worx for customer collection, customers will be notified when it is ready.

 

Unless otherwise agreed, Potter Worx will hold completed pottery for 30 days from the date of notification.

 

If pottery remains uncollected after this period, Potter Worx will make reasonable efforts to contact the customer before disposing of or donating the item.

Potter Worx is not required to store uncollected pottery indefinitely.

 

12. Photography, Video & Media

Potter Worx may photograph or record its events, pottery displays or completed creations for legitimate business and promotional purposes where it is lawful and appropriate to do so.

 

Where identifiable adults are the focus of promotional photography or video, Potter Worx will provide appropriate information and obtain any consent required for the intended use.

 

Children

Potter Worx will not photograph or record identifiable children for marketing or promotional purposes without appropriate prior permission from their parent or legal guardian and, where relevant, agreement with the host nursery, school or organisation.

 

Choosing not to provide photography or video permission will not affect a child's ability to participate in a Potter Worx activity.

Where permission has been provided, photographs or recordings will be handled in accordance with the Potter Worx Privacy Policy and applicable data protection law.

 

Customers may voluntarily submit photographs of their pottery or experience to Potter Worx. Any intended promotional use involving identifiable individuals will be handled in accordance with applicable privacy and data protection requirements.

 

13. Personal Information & Privacy

Potter Worx processes personal information in accordance with its Privacy Policy and applicable UK data protection law.

 

Information necessary to administer a booking may include customer contact details, payment or booking information and information reasonably required to deliver the booked experience.

 

Potter Worx will only use personal information for the purposes explained when it is collected and as described in our Privacy Policy.

 

We do not sell customer personal information.

 

Where an event involves children, Potter Worx will take particular care when collecting, using or sharing children's personal information.

 

14. Website & Intellectual Property

Unless otherwise stated, website content, Potter Worx branding, original written materials, graphics and other intellectual property made available by Potter Worx are owned by or licensed to Potter Worx Ltd.

They may not be copied, reproduced, distributed or commercially reused without prior written permission except where permitted by law.

Potter Worx may update its website, services and pricing from time to time.

Any change in pricing will not retrospectively alter the agreed price of a confirmed booking unless the customer expressly agrees otherwise or the booking terms provide for a lawful adjustment.

15. Liability & Statutory Rights

Potter Worx is responsible for providing its services with the level of reasonable care and skill required by applicable law.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for:

  • Death or personal injury caused by our negligence;

  • Fraud or fraudulent misrepresentation; or

  • Consumer rights and remedies that cannot lawfully be excluded or restricted.

 

Subject to those rights, Potter Worx is not responsible for losses that were not reasonably foreseeable when the contract was entered into or losses resulting from circumstances for which Potter Worx is not legally responsible.

 

Where a customer is acting wholly or mainly for business purposes, different legal rights may apply and any additional business-to-business terms agreed as part of the booking will also apply.

 

16. Event-Specific Terms

Some Potter Worx events, collaborations, ticketed experiences or bespoke services may have additional terms that apply specifically to that booking.

 

These additional terms will be made available before the booking is completed where applicable.

 

Where event-specific terms conflict with these general Terms in relation to that particular event, the event-specific terms will take precedence to the extent of the conflict.

 

Nothing in event-specific terms or these general Terms affects statutory rights that cannot lawfully be excluded or restricted.

 

17. Complaints & Contact

If you are unhappy with a Potter Worx service, finished item or booking experience, please contact us as soon as reasonably possible so that we have an opportunity to investigate and resolve the issue.

18. Governing Law & Jurisdiction

These Terms are governed by the laws of England and Wales.

 

If you are a consumer resident elsewhere in the United Kingdom, you may also benefit from mandatory protections available under the laws applicable to you.

 

Nothing in these Terms prevents a consumer from exercising any right they may have regarding where legal proceedings may be brought.

 

19. Changes to These Terms

 

Potter Worx may update these Terms from time to time to reflect changes to our services, business practices or applicable law.

 

The Terms applicable to a confirmed booking will normally be those provided or made available when the booking was entered into, unless a subsequent change is required by law or is expressly agreed with the customer.
